Supreme Court ruling:
in the case of R (ZH and CN) v London Borough of Newham and London Borough of Lewisham[2014] UKSC 62,. The court ruled that possession orders are not required for temporary accommodation matters. London Bailiff services are able to act to remove occupants without the need for court proceedings.
Excluded Occupiers
The term “excluded” refers to occupants being excluded from terms of the Protection from Eviction Act 1977. This means that there is no requirement to obtain a possession order from a court to evict an excluded occupier. The landlord can simply take possession of the premises.
An excluded occupier can be a lodger, a family member who occupy premises without a lease without being asked to pay rent, or persons with no right to rent where the Home Office has served notice on them.

Former trespassers granted temporary rights to occupy
Occupying holiday lets
Occupying rent free accommodation
Asylum seekers in government provided accommodation
Licensees in local authority hostels
People with no right to rent where the Home Office has served notice
Use of Force
It is an offence for any person ‘without lawful authority’ to use violence to secure entry to premises under the Criminal Law Act 1977. There is a fine line as to what is and is not lawful in these circumstances so using experienced Enforcement Agents such as London Bailiff Services is key in order to evictions of this type are carried out correctly.
Illegal Evictions
Local authorities have the power prosecute for illegal evictions, and the police can also arrest a person who is committing or is about to commit an illegal eviction. In either scenario any person found guilty of the offence can be fined or sentenced to imprisonment or both.
